The Plainville Police Department has reported the following arrests.
•Cristian B. Marvin, 21, of 138 Sheffield Lane, Bristol, was charged on Oct. 17 with third degree assault, third degree criminal mischief and disorderly conduct. Bond was set at $2,500 with an Oct. 27 court date.
•Alexander Kolozvary, 57, of 126 New Britain, Ave., unit F3, Plainville, was charged on Oct. 18 with disorderly conduct, third degree assault, second degree reckless endangerment, and second degree strangulation. Bond was set at $50,000 with an Oct. 20 court date.
•Rafael A. Serrano-Zeno, 46, of 50 High St., unit 340, New Britain, was charged on Oct. 18 with operating under suspension and an emissions violation. Bond was set at $1,000 with an Oct. 27 court date.

Police in search of robbery suspects at Marshalls

pic 1 pic 2Plainville police has asked for the public’s help in identifying two suspects involved in a robbery that happened Monday at Marshall’s on New Britain Avenue, according to a media release.
While trying to shoplift at Marshall’s, the unidentified female suspect threatened a loss prevention employee with a knife, stated the release. No one was hurt during the incident. Police said in the release that the suspects fled in what was described as a newer, white colored Hyundai with a distinctive large black triangle painted on the vehicle’s hood.
If anyone recognizes these suspects, call Detective Marc Rivard or Detective Sergeant Nicholas Mullins at (860) 747-1616.

New Britain Ave. bank robbed Thursday night

The Plainville Police Department is investigating an armed robbery that occurred on Thursday night shortly after 6 p.m. at the American Eagle Federal Credit Union on New Britain Avenue, Plainville.

Police said a lone male entered the bank while brandishing a firearm and demanded the the employees hand over money. Police said the male made off with an undisclosed amount of cash. Police said no one was injured in the incident.

Police said the suspect was described as white with an Eastern European accent. He is about 5’8” tall and appeared to have an average build. Police said he was wearing a dark jacket, gray hood, a dark baseball cap, and had a mask covering his face.

Police said detectives are exploring the possibility that this robbery may be related to others in the area.

Webster Bank on Pine Street in Bristol was robbed Tuesday night, according to Bristol police. The description of the suspect, according to the Bristol reports, was similar to the Plainville incident, right down to the Eastern European accent.

Police said anyone with information is asked to call Detective Marc Rivard at (860) 747-1616.

Court: Media don’t have to delete stories when charges nixed

NEW YORK (AP) _ A Connecticut woman’s claims that media outlets libeled her by refusing to delete stories about her arrest after charges were dismissed were rejected by a federal appeals court Wednesday.

The ruling by the 2nd U.S. Circuit Court of Appeals in Manhattan pertained to the August 2010 arrest of Lorraine Martin. The charges were dismissed five months later and the arrest was deemed to have never taken place according to the state’s Erasure Statute.

In an opinion written by Judge Richard Wesley, the appeals court said a lower-court judge was correct to dismiss the lawsuit, which claimed libel, negligent infliction of emotional distress and invasion of privacy. Local newspaper reports online quoted police as saying Martin was arrested after officers confiscated 12 grams of marijuana from her Greenwich, Connecticut, home.

The ruling by the three-judge panel acknowledged that the consequences of a criminal arrest are wide-ranging and long-lasting, even when someone is later exonerated or the charges are dismissed. But the judges said Martin misunderstood the effect of the Erasure Statute when she concluded that it made it factually false to say she was arrested.

The appeals court said the law bars the government from relying on police, court or prosecution records in a later trial and prevents judges from citing a deleted arrest to enhance a sentence for a later offense.

“The statute creates legal fictions, but it does not and cannot undo historical facts or convert once-true facts into falsehoods,” Wesley wrote. “Here, the uncontroverted fact is that Martin was arrested on Aug. 20, 2010, and that the reports of her arrest were true at the time they were published. Neither the Erasure Statute nor any amount of wishing can undo that historical truth.”

The 2nd Circuit said reasonable readers understand that some people who are arrested are guilty and others are not and that charges against some individuals are eventually dropped.

Martin’s attorney, Ryan O’Neill, said they are disappointed and are considering an appeal to the Supreme Court.

O’Neill said it should be left to a jury to decide the case.

“These stories, because of the way the Internet operates, are perpetually fresh and available on the newsstands,” he said. “There’s a reason these things are kept out there: because it attracts a lot of readers, notwithstanding that it’s old news.”

He said other news publications had in the past agreed to delete old stories or update them when circumstances change.

Martin had sued the Hearst Corp., Southern Connecticut Newspapers Inc. and Main Street Connect LLC over stories that appeared on the Internet, including accounts in the Connecticut Post, the Stamford Advocate, Greenwich Time and News 12 Interactive.

Lawyers for the media companies did not immediately return messages for comment.

Woman charged with assault of her infant son

A Plainville woman was arrested on Feb. 11, accused of assaulting her two-month old child.

Police said Caitlin Knight, 27, of 167 Stillwell Dr., was arrested and charged with assault in the first degree and risk of Injury to a minor.

Plainville police said that on Dec. 17, 2014, officers responded to 167 Stillwell Dr. in Plainville for a report of an injured and unconscious infant. The two-month-old male infant was transported to the Hospital of Central Connecticut at New Britain General and later to the Connecticut Children’s Medical Center. The infant suffered multiple injuries, including serious head injuries.

At present, police said, the injured infant remains in critical condition and has been in this condition since the date of the incident.

Police said the original information was the infant suffered injuries due to an accidental fall, but a police investigation and an examination by medical personnel revealed evidence the infant’s injuries were not consistent with such an accident.

Arrest made for Econo Lodge burglary

On May 9, Southington police were dispatched to Econo Lodge, 1845 Meriden-Waterbury Tpk., in Southington at approximately 2:30 a.m. after receiving calls about a suspicious male. Police said in a release that a male suspect, later identified as Roberto Ettorre, age 42 of Plainville, allegedly entered a complainant’s room while he was sleeping. Ettorre entered the room through an unsecured door, took money, and left.

When officers reviewed video surveillance, they reported that Ettorre was observed exiting his room and slowly walking into the complainant’s room, through a slightly opened door. Ettorre was observed exiting the room, walking down the hallway, but returning to the area. Ettorre then entered the room a second time, and after a short time, he leaves the room and runs down the hallway.

The complainant reported that $17 was missing from his room. Officers located Ettorre inside his hotel room.

Ettorre was arrested and charged with two counts of Burglary in the second degree and one count of sixth degree larceny. He was released on a $10,000 bond and is scheduled to appear in court on May 18.
